Trustee's Responsibilities

The role and responsibility of a trustee of an SMSF is to appoint an auditor

As a trustee of an SMSF, your client is required to appoint an approved auditor to audit their fund each year, at least 30 days before the due date of the SMSF annual return.

In accordance with the ATO the auditor is required to:

  • examine the fund's financial statements; and
  • assess the fund's overall compliance with the super law.

Auditor obligations

As per the ATO Nest Super is obligated to:

  • provide the Trustee/s with an audit report before the due date of the SMSF annual return
  • bring to the ATO's attention and the attention of the Trustee/s, any concerns about the fund's financial position or its compliance with the super law
  • report to the ATO certain contraventions of the super law that we may identify during an audit.

If we identify a contravention, the Trustee/s need to take immediate steps to rectify the contravention.
